ADVENTURE TOUR TERMS & CONDITIONS

Thank you for using THE OFFROAD TRADIES ABN:17 341 261 179. Our services are provided to you subject to the following terms and conditions.

Covid-19 Policy & Procedure.

 

VACCINATIONS

All guests must provide proof of double vaccination for COVID19.

This protects other guests and staff on tour, those people living in remote communities in the areas we visit.

You may also need to be vaccinated to enter certain areas as per government regulations, from crossing state borders, Indigenous communities, attractions, pubs, and restaurants, your undertaking is to provide proof of vaccination status to the satisfaction of the third party.

The Offroad Tradies accept no responsibility for forfeiture of any payment’s fees or charges for failure to comply.

 

COVID-19 CANCELLATION

We would like to assure our clients travelling as part of a The Offroad Tradies 4WD Adventure Tag-Along Tours; that if a participant/s receive a positive test (or are required to self-isolate due to a household contact) 10 days prior to departure you the participant will be offered the option of a 50% refund of all monies paid or credit to use on a future booking**.

Credits will expire 18 months after issue.

To receive the refund participant/s must provide evidence of the result from the relevant Department of Health in the participant/s state or territory.

 

Our COVID-19 rules and regulations are in line with the current (April 2022) government guidelines and are subject to change accordingly.

 

MEDICAL MATTERS

Travelling in remote areas, exploring and 4WDring are things we enjoy but there are inherent risks and dangers associated with this type of travel. Some of which can result in illness, injury or death. These risks are increased by the fact that these trips take place in remote locations, far from medical facilities. Upon joining any of our 4WD Tag-Along Adventure Tours you and participants understand and accepts all such risks associated with parting in these activities and do so at your own risk.

 

     a) You acknowledge that you do not have any pre-existing medical condition or disability (including those disclosed on the The Offroad

         Tradies Booking Form) which will impact on or prevent you from participating in or completing the tour.

         It is your responsibility to ensure that you are medically capable of completing the Tour.

 

     b)  Tours are carried out in areas with limited medical services.

          You authorise The Offroad Tradies to take such action as is necessary (but without any obligation on The Offroad Tradies to do so) for the

         provision of medical services at your cost, including but not limited to, the arrangement of any medical evacuation service by air/road, the

         attendance of any doctor, nurse, paramedic or ambulance officer and any necessary hospital service.

 

       You understand that the costs on time to the provider of the services is required to be reimburse The Offroad Tradies within seven days of

        demand.

  • It is the responsibility of the participant to make sure you and your participants are well insured. Including hospital cover, ambulance cover and any other medical requirements.

​

     c)  You are not entitled to any refund for any part of the Tour that you miss due to sickness, illness, or injury or due to other circumstances 

          outside the control of The Offroad Tradies.

​

     d)  It is the responsibility of the participant to make sure you are well insured, and that you are physically fit, medically willing, and able to

          partake in the adventure.

 

     e)  You give permission for The Offroad Tradies tour guides to provide basic first aid (without any obligations to do so), as required or until

         medical professionals arrive and that The Offroad Tradies Tour Guides are not liable for any injuring, illness including death that may

         occur during or as a result from this.

 

VEHICLE MATTERS

We are passionate and experienced 4WDrivers, (and licences tour operators).

Should your vehicle break down, The Offroad Tradies will use reasonable endeavours to assist with the recovery of the vehicle. We are not obliged to assist or “fix” anything that would jeopardise the safety of any person or pose risk to property of The Offroad Tradies. Nor are The Offroad Tradies liable for any current, additional or future issues with the vehicle that may arrise

​

The tour price does not include the cost of any vehicle repairs, towing expenses or any other third-party costs that may be needed for you to continue the tour.

  • It is the responsibility of the participant to make sure your vehicle/s are well insured.

          Including comprehensive vehicle insurance in addition to third party insurance plus a premium roadside service cover with the relevant motoring body from their State eg RACV, NRMA or RACQ.

You agree that:

     a)  All drivers of your tour vehicle hold a current and valid Australian driver’s licence.

     b)  You are responsible for your vehicle and the persons in that vehicle

     c)  Acknowledge that the driver and passenger/s are to demonstrate a duty of care to all other road users, members of the public and

          other tour participants.

     d)  Will be liable for any traffic offences incurred during the tour in relation to your vehicle or driving.

     e)  Your tour vehicle is roadworthy and registered under the laws of the State in which you live, prior to departure and for the course of the

          tour.

Failure to meet these standards may result in penalties, fines, fees, or charges and are completely your responsibility. The Offroad Tradies takes no responsibility for failure to comply with these.

 

You are responsible for the maintenance of your vehicle during the tour. This includes regularly checking batteries, fuel, water and oil levels, tyre pressures and air filters.

​

You are responsible for properly loading your vehicle and for taking proper precautions for the safe carriage of your load including dangerous goods such as gas cylinders; ensuring that you comply with all manufacturers’ recommendations for the carrying of loads including trailers.

Our 4WD Tag-Along Adventure Tours are undertaken primarily on rough, unsealed roads and through varying terrain including sand, gravel, mud, and creek crossings.

Our tours are self-sufficient 4WD experiences that traverse remote areas, which at times can be challenging

You agree that:

    a)   All drivers of your tour vehicle have sufficient driving experience and expertise to safely drive in those conditions and to maintain the

          pace of the tour.

    b)   Your vehicle can be driven in those conditions and at the pace of the tour group.

 

BOOKING & PAYMENT TERMS

To make a booking.

Complete The Offroad Tradies booking form via The Offroad Tradies website; along with a deposit for the desired tour as specified on the booking form.

The Offroad Tradies will accept deposits; to be paid by credit card, bank transfer, cash or cheque and reserves the right to pass on any credit card, bank transfer, PayPal or any other fees associated with receiving the deposit amount.

The final balance of the amount payable is due on the date identified on the specific tour information sheet.

Cancellation may be subject to penalties & charges as set out in the schedule below:

(Calculated on the total value of the booking).

 

CANCELLATIONS

All cancellations are required to be made in writing to The Offroad Tradies.

​

  • More than 30 days prior to departure date - No penalty

  • 30 - 15 days prior to departure date – Refund 75% of all monies paid**

  • 14 – 7 days prior to departure date – refund of 50 % of monies paid**

  • 7 days or less prior to departure - No refund

  • Failure to depart on tour - No refund

  • Leaving during tour - No refund Liability

  • Refund for COVID 19 – refer to Pg1. Terms and Conditions.

 

**Deposits we receive from you the client are used to secure your booking and services with suppliers and are therefore subject to supplier terms and conditions and may not be refundable.

Refundable deposits are at the discretion of The Offroad Tradies where direct cost of booking suppliers and tour expenses have not been incurred or in the event a supplier agrees to refund the holding deposit.

 

In the event of a cancellation or alteration to the trip as a result of the circumstances as described in the Terms & Conditions documentation, The Offroad Tradies may in their sole and absolute discretion:

a)     offer the participant(s) alternative travel arrangements

b)     if alternative travel arrangements are made or offered by The Offroad Tradies, The Offroad Tradies will make a prompt proportional refund

        of monies paid by the participant.

​

The Offroad Tradies may charge a reasonable fee to cover the administration costs associated with providing alternative travel arrangements or products.

​

ACCOMMODATION

All accommodation, and specification are as shown in the itinerary, and are subject to change as required.

The Offroad Tradies purchases, hotel, caravan park and other national park accommodations, restaurant, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result, The Offroad Tradies are not liable for any negligent or willful act of any such person or entity or of any third person.

MEALS

Meals are as shown in the itinerary. The Offroad Tradies offers fully catered tours. These include three main meals for each day on tour. Tour guides hold a current and valid food handlers’ certificate. Some meals are prepared and take place in restaurants, farm stays and pubs.

Any food allergies are required to be noted on the booking form. The Offroad Tradies will do their best to accommodate to these requirements and cannot guarantee cross contamination. The Offroad Tradies are not liable for any illness or death that may occur from food products and/or allergies.

ITINERARY

Accommodation and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances beyond The Offroad Tradies control. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued.

The Offroad Tradies also reserves the right to withdraw a tour or any part of it. The Offroad Tradies make such alterations to the itinerary or the tour inclusions as it deems necessary, safe, or desirable, which may cause delays to tour and activities beyond its control. These include environmental factors.

In case of any appreciable variation in the tour price due to these circumstances, The Offroad Tradies reserves the right to adjust the tour costs, as necessary.

PHOTOGRAPHY/ VIDEOGRAPHY

The Offroad Tradies reserves the right to take photographs, and videos during the operation of a 4WD Adventure Tag-Along Tour. In turn this footage and/or photography can and will be used for promotional purposes on website, social media, YouTube and promotional material.

By booking a tour with The Offroad Tradies, participant/s agree to allow their images to be used in such photographs and videos.

Participant/s who prefer that their images not be used are asked to identify themselves to The Offroad Tradies Tour Guides in writing prior to final payment and/or departure and they will be exempted from this Photography/Videography waiver clause.

​

TRAVEL ADVISORIES/WARNINGS

In the event of a travel warning, and environmental warnings referred to by respective government agencies, against travel to a specific destination/location(s) The Offroad Tradies can cancel or adapt tour at any time as per recommendations.

Refunds or credits will be available if/when required and are at the discretion of The Offroad Tradies.

Participant assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.

 

INSURANCES & LAWS

The Offroad Tradies is insured for liability when conducting the business and hosting 4WD Adventure Tag-Along Tours.

This does not include personal injury, medical evacuation, ambulance, vehicle, cancellation, or any other type of insurance for individuals, groups, or business partaking in activities with The Offroad Tradies.

 

It is your responsibility to obey all state and local laws while on tour.

We draw your attention to the laws applying to the limited transportation and use of alcohol in some communities.

You agree that any penalties, fines, payment’s fees, or charges are completely your responsibility. The Offroad Tradies takes no responsibility for failure to comply.

 

In addition, and without limitation, The Offroad Tradies, is not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection to the provision of any goods or services. The Offroad Tradies may suspend its obligations under this agreement if its ability to perform is affected by but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or for failure of any transport mechanism to arrive or depart on time.

You release The Offroad Tradies from all Claims and liabilities arising out of or relating to your participation in the tour, including (but not limited to) actions (or inactions) of The Offroad Tradies undertaken pursuant to these terms, and including those caused or contributed to by third parties, including suppliers to The Offroad Tradies and other participants on the tour.

For the purposes of this clause “Claims” means any allegation, cause of action, claim, demand, proceeding, litigation, investigation, judgement, loss, cost or expense of whatever nature and whether present or future, fixed or ascertained, actual or contingent and whether arising at law or in equity, under statute or otherwise.

​

You indemnify The Offroad Tradies for any loss suffered by it and against all Claims (as defined in the preceding clause) and liabilities arising out of or related to your participation in the Tour and any breach by you of these terms.

 

TERM & CONDITIONS

A booking form, payment and terms and conditions form must be complete by all participants prior to departure.

 

These Terms and Conditions can only be amended in writing by The Offroad Tradies owner/operators. They are incapable of amendment or waiver by a participant, client, an employee, agent, or representative of The Offroad Tradies or by any other supplier.

This Agreement is, and shall be governed by, and construed in, accordance with the laws within each Australian state and/or Territory
